WHO WE ARE

The Privacy Policy explains the data protection provisions of Sony Music Entertainment Korea, Inc. , a company incorporated in Korea (the “Territory”).  Where we refer to “SME”, “us” or “we”, we mean Sony Music Entertainment Korea, Inc. (or any Sony Music Entertainment entity using your data in accordance with this Policy).

We will try our best to protect your privacy and treat your personal data based on the following provisions. Please read the Policy carefully to understand our views and practices regarding your personal data and how we will treat it.

HOW WE COLLECT YOUR DATA

(a) From you

Company collects and uses your personal information for membership subscription, consultation, events, fax/telephone, etc. This personal information may include the data which you provide for registration to use our site (or membership registration), service use records (newsletter, etc.), purchase of products/services, posting materials or requesting services.

(b) By using cookies

We may use ‘cookie’ to collect data for and/or arising out of your internet use. This data may include IP-address, browser version or number of your visits and similar information about your use of the Internet and our site. A ‘cookie’ will be stored on your computer as a small text file. When a member accesses the website, it will link the contents of the cookie contained in the member’s browser  The cookie will be used for (1) providing the information based on your interest on the internet, (2) marketing based on analyzing user’s frequency of visit or duration of stay on the web site, (3) providing users the tailored information by tracking the user’s interest, (4) introducing users the duration of their use on the web when subscribing and (5) improving our sites, content, products and services.

You may block this cookie by deactivating on your internet browser. However, deactivating cookie may lead difficulties in access to a part of our sites.

TRANSMISSION OF YOUR DATA VIA THE INTERNET

It is the user’s responsibility to keep their personal data up to date to immediately check the information such as termination of service or change of SME’s policy. The user will be responsible for the accident from typing inappropriate information or even the membership will be terminated if they illegally use the information from the others.

We will try our best to prevent your data from being illegally released to the third parties through our strict security system. However, we cannot guarantee to perfectly protect your personal information from being leaked to the third parties.

You should be aware of keeping your personal information private including your ID or password and we ask you to not share your personal information with the third parties. Especially, when you share your electronic devices such as PC and other terminals with others, please make sure closing our web after logging out. Otherwise, there is a high risk that your personal data will be easily leaked and changed by the third parties. 

TRANSMISSION OF YOUR DATA VIA THE INTERNET

The data that we collected from you may be transferred to or stored at the different places (based on the Policy ‘WITH WHOM WE SHARE YOUR DATA’) in certain cases like that any of our servers are located outside the Territory or any of our service providers is located outside the Territory..

In the final storage/delivery place where they do not have data protection laws as strict as we do, we will take all steps necessary to ensure that your data is only legally transferred outside the region and used for the right purpose in accordance with Privacy Policy.

HOW WE USE YOUR DATA

We use the data collected from our you in the following ways:

(a) to establish your identity;

(b) to ensure that content from our site is presented in the most effective manner for you and your computer and is optimized for your needs;

(c)  to use such information on our web site to get aggregate statistics;

(d) to analysis in order to help us create the website contents and develop usage method that is most relevant and user-friendly;

(e) to provide you with information, products or services that you have requested from us (or third parties, where appropriate) or based on your preferences or use, we feel that may interest you;

(f) to carry out our obligations arising from any contracts entered into between you and us;

(g) to allow you to participate in our service, when you choose to do so;

(h) to enable credit checks – such as analyzing, verifying and/or checking your credit, payment and/or status in relation to your ability to use any e-commerce-related services (if any) on our website; and

WITH WHOM WE SHARE YOUR DATA

Based on the other provisions on this Policy, we may share your personal data with the following parties:

(a) Group companies and third party service providers

We may share your personal data with our affiliated groups and third parties**.

Also, (1) in case of implementation of terms and conditions relating to services provided and settlement of charges for services provided or (2) if there are special provisions in laws and regulations such as Enforcement Decree of The Protection of Communications Secrets Act, Basic Act for National Taxes, Act on expansion of Dissemination and Promotion of Utilization of Information System, Enforcement Decree of The Telecommunications Business Act, Enforcement Decree of The Local Subsidy Act, Criminal Procedure Act, etc., we may provide your personal information to the third parties without the member’s consent.

However, in case that we are requested to provide your personal information by the administrative office or investigative agency for administrative or investigative purposes, we do not unconditionally provide your information, rather, we provide them only when we may assure that the data is required by the law, such as in the case of a warrant or a written request sealed by the head of the institution as stipulated in the law.

(b) Other third parties**

We may transfer or assign the data, including personally identifiable data, to third parties, only in connection with the sale, merger, consolidation, change in control, transfer of substantial assets, reorganization or liquidation of SME, or any part of it.

We may share with others, at our discretion, your aggregate statistical data regarding purchases and the use of our content, which may include demographic data such as the age range. The personal addresses may also be identifiable from such statistics.

(c) In special circumstances

We may disclose personal data in special cases when we have reason to believe that disclosing data is necessary to identify, contact or bring legal action against someone who may violate or interfere (either intentionally or unintentionally) with the rights or property of those described above in paragraphs (a) or (b). We may also disclose your personal data when we believe that the law requires us to do so.

**Note:  Your personal data will not be disclosed by us to third parties except Sony Corporation or affiliated groups without your consent for marketing or promotional purposes.

PERIOD OF RETENTION

When the personal information becomes unnecessary owing to membership withdrawal or attainment of the purpose of collecting and processing the personal information, we will destroy such information without delay. However, we keep user’s personal information for the following cases.

1. When it is based on the company’s internal policy: it is used for the prevention of re-subscription of defective users, prevention of fraudulent use, billing for non-payment of service charges, and responding to complaints, etc.

– Retention period: for six (6) months after cancellation of membership (however, in case of unpaid billing for the service, the period extends until it is fully paid. In case of complaints, the period extends until the problem is solved)

– Retaining information: ID, name, e-mail, telephone number, Certificate Information (CI), registration date, or cancellation date

2. When the users asked us to keep their information or we directly acquired consents from the users.

– Retention period or retaining information: the personal information will be retained until we are asked to do.

3. When the law requires the Company to store the information even without the permission of users. 

YOUR RIGHT TO OBTAIN, CHANGE OR REMOVE YOUR DATA

You can always block receiving any further messages from SME or anyone with whom we share your data (as described above) at any time by following the unsubscribe instructions. If you wish to unsubscribe messages we send you, you can also send an email to [email protected].

You have a right to access or correct the personal data we retain for you. To obtain a copy of the personal information we retain, please contact us at our registered address provided at the beginning of this Privacy Policy.

OTHER WEBSITES

We’ll always try to adhere to our strict guidelines and select only trustful partners in providing the service. However, the information that you directly provided to the third parties (including, but not limited to, online commerce sites and other hyperlinked websites) is not within the scope of our protection. Hence, we highly recommend you to consult with the experts before providing your data to the third party.

Our website may contain links to other websites that are out of our control and are not covered by this Privacy Policy. If you access to other sites by using these links, the operators of these sites may collect and process information from you in a different way as we do. If you click a link included in the homepage and move to a pager on another site, the Private Policy of SME (Sony Music Entertainment) will no longer apply to the use of that site.

CHANGES TO OUR PRIVACY POLICY

We are careful about users’ privacy issues and recognize the need to update this policy if we start new business services.  Accordingly, we may modify, alter or otherwise update this privacy policy at any time. We will indicate any changes by updating the date at the top of the policy. We encourage you to review this policy from time to time.
